Resolution of Disputes

Amicable resolution :

Penalties for failure to submit a vehicle for inspection

If your vehicle is more than four years old and has not been tested within the prescribed time limit, you may be liable to a fine (€135 euro at 1 January 2002). Your vehicle registration document ('grey card') may also be retained by the authorities and you must present the vehicle for inspection within seven days.


Regulations on vehicle maintenance

Article L311-1 of Code de la Route

All vehicles must be constructed, sold, used, maintained and, if necessary, repaired in such a way as to ensure the safety of all road users. Enforcement of this article is determined by decrees of the Council of State.


Modifications to vehicles

Article R321-16 of Code de la Route

Any individual vehicle or vehicle component that has been subject to significant modification must be submitted to a new type approval process. The owner of the vehicle or vehicle component must submit a request for type approval to the préfet.
The minister of transport is responsible for specifying which modifications are considered as requiring new type approval.


Article R322-8 of Code de la Route

If any vehicle subject to registration and already registered is modified in any way likely to alter the characteristics listed on the registration document, the owner must submit a declaration to that effect to the préfet of the departement in which the vehicle is registered, together with the registration document for the vehicle concerned so that this may be updated.
This declaration must be in the form determined by the minister of transport and must be submitted within fifteen days of the modifications being carried out.
Failure to make such a declaration, in the form and within the time period specified in this Article, will render the owner of the vehicle liable to the fine specified for a Class 4 offence.
